HACA Approval?

The Hill Area Conservation Authority (HACA), constituted by G.O.No.44 in 1990, regulates all construction in 597 notified hill villages across Tamil Nadu. Building without HACA clearance in these zones is illegal — structures are liable for demolition.

Districts Requiring HACA / AAA Clearance

These districts have notified hill villages under HACA jurisdiction. Verify your survey number before purchasing land or commencing any development in these areas.

Full HACA
Nilgiris District

Entire district under HACA. Includes Ooty, Coonoor, Kotagiri, Gudalur taluks. AAA Committee headed by District Collector gives building licences. All proposals referred to HACA before final approval.

Partial HACA
Dindigul District — Kodaikanal

Kodaikanal area and surrounding notified hill villages under HACA. AAA Committee constituted with District Collector as Chairman. Strict conservation norms apply to all construction above 300 sq.m.

Partial HACA
Salem District — Yercaud

Yercaud and surrounding hill areas. AAA Committee with District Collector as Chairman and Regional Deputy Director of TCP as Convenor. Building licences via AAA-HACA route.

Hill Areas
Theni, Tirunelveli, Kanyakumari, Coimbatore Hills

Western Ghats hill ranges in these districts have notified HACA villages. Check survey number at District Collector's office or VAO to confirm HACA applicability before any investment.

Forest Fringe
Erode, Krishnagiri, Dharmapuri

Selected hill areas and forest fringes. Any development within 500m of Reserve Forest boundary requires Forest Conservation Act compliance regardless of HACA status.

300 sq.m Threshold Rule

All buildings exceeding 300 sq.m (approx. 3,229 sq.ft) in HACA areas require mandatory HACA clearance before construction begins. Residential homes below 300 sq.m proceed with local approvals but remain subject to hill-area bye-laws.

Commercial Buildings — Full HACA Mandatory

Hotels, resorts, restaurants, and commercial complexes in HACA zones require comprehensive HACA approval regardless of size. The commercial use classification triggers full scrutiny automatically without exception.

Industrial Activities — Generally Prohibited

Industrial activities are generally prohibited in HACA areas or subject to heavy restrictions. Special permission from HACA is required — and rarely granted for heavy industry or any polluting process.

Slope & Forest Restrictions

Construction is prohibited on slopes exceeding specified gradients (typically 30 degrees). Strict setbacks from natural streams, lakes, and water sources are enforced. No construction near forest boundaries without Forest Dept clearance.

HACA Application Process

Applications processed based on specific survey numbers. Submit to District Collector's office → Preliminary review → HACA Committee technical evaluation → State Government order. JP Buildcorp manages the complete HACA application and AAA Committee follow-up.

2026 Legal Note — Important

A 2026 Government Order attempting to reduce HACA's role for layouts is currently under challenge at the Madras High Court. Developers in hill areas are advised to follow the full HACA process pending court resolution to avoid future legal complications with their approvals.
